- What is GDPR?
Starting from May 25, 2018, the new General Data Protection Regulation (GDPR) came into effect, replacing the previous Personal Data Act (PuL). GDPR introduces several changes for both individuals and companies.
GDPR primarily focuses on how personal data can be collected and processed. Therefore, the regulation concerns anyone who, in any way, processes personal data.
- What is personal data?
The concept of personal data is very broad and refers to all information related to an identified or identifiable natural person.
Any data that can be directly or indirectly be linked to a physical person is considered personal data. This includes, for example, names, telephone numbers, email addresses. Also, images and other information that, when combined with other data, can identify a person are considered personal data and must be handled in accordance with GDPR.
- How does GDPR affect you as a customer of ours?
In the relationship between you as a customer and us, two concepts are particularly relevant: the data controller and the data processor.
A data controller is the one who determines the purposes for which personal data should be processed and how the processing should be carried out, while a data processor is someone who processes personal data on behalf of the data controller. In our agreement with you as an IT partner or IT service provider, various personal data are processed, such as the names, telephone numbers, and email addresses of your employees.
- Data Processing
Agreement for you as our customer, an appendix to the agreement is a data processing agreement detailing how we process your personal data in accordance with GDPR. The agreement complies with the requirements that GDPR imposes on data processing agreements and its content.By signing the agreement, you fulfill the GDPR requirement for you as a data controller to enter into an agreement with us as your data processor. The only obligations the agreement specifies for you are to comply with applicable legislation, provide us with instructions regarding the processing of personal data, and not disclose the content of the data processing agreement to any external party. In practice, this means that you do not take on any new obligations.
